Elder Law – Includes preservation and/or transfer of assets seeking to avoid family impoverishment when a loved one enters a nursing home. Estate planning, including planning for the management of your family’s estate during life and disposition on the death of a family member through the use of trusts, wills, powers of attorney and guardianship. Disability planning including durable powers of attorney, special needs trusts, Able Act accounts, living trusts and living wills for financial management and health care decisions, as well as guardianship when necessary.
Disability Benefits – Disability benefits are designed to protect people who cannot work or are limited in their capacity to work due to a health condition. They are:
Social Security - The Social Security Administration pays disability benefits through two programs: the Social Security Disability Insurance program and the Supplemental Security Income (SSI) program. You should apply for benefits as soon as you become disabled because it takes a long time to process the application. The Social Security website estimates it can take 3 – 5 months for the initial decision. An initial denial does not necessarily mean the applicant is not entitled to benefits. Spinks Law Firm has experience representing people in the application and appeals process with resources dedicated to recovering benefits for clients.
Special Needs – In addition to Social Security benefits, there are a number of Federal, State and local benefits for children with special needs, we help with advocacy/review of your child's IEP/504 plain and ensure it meets the standards of IDEA.
